These Terms of Service ("Terms") govern your access to and use of www.tredera.com (the "Site"), including any purchases of LED Halloween masks and related accessories ("Products") and any companion app used to control Product lighting patterns (the "App"). By accessing the Site, placing an order, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the Site, purchase Products, or use the App.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order on the Site. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian.

2. Products and Orders

2.1 Product Descriptions

We attempt to describe and display our Products, including lighting patterns and app functionality, as accurately as possible. We do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or error-free.

2.2 Pricing and Availability

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to limit quantities, refuse or cancel any order, and correct pricing or listing errors at any time, including after an order has been submitted or confirmed.

2.3 Order Acceptance

Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for any reason, including suspected fraud, pricing errors, or unavailability of a Product.

3. Payment

Payment is processed through our third-party payment processor at the time of order. You represent that you are authorized to use the payment method provided. We are not responsible for errors made by payment processors.

4. Shipping, Returns, and Refunds

4.1 Shipping

Shipping times and costs are estimates and are not guaranteed. Risk of loss and title for Products pass to you upon our delivery to the shipping carrier.

4.2 Returns and Refunds

Unless otherwise stated in a separate Return Policy posted on the Site, Products may be returned within 30 days of delivery if unused and in original packaging. Refunds are issued to the original payment method. Sale items, used items, and items showing signs of use may not be eligible for return. Seasonal/holiday-timed items may have shortened return windows near and after Halloween; any such changes will be posted on the Site.

5. Companion App and Product Use

If your Product is controlled via our companion App, use of the App is subject to these Terms and any additional in-app terms or permissions (such as Bluetooth access) required for functionality. You are responsible for using LED Products safely, including avoiding use that could impair vision or cause harm (e.g., strobe/flashing patterns for individuals sensitive to flashing lights). We recommend reviewing all safety warnings included with your Product.

6. Intellectual Property

All content on the Site and within the App, including text, graphics, logos, product photography, lighting pattern designs, and software, is owned by or licensed to Tredera and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Site or App content without our prior written consent.

7. Prohibited Conduct

You agree not to:

Use the Site or App for any unlawful purpose or in violation of these Terms.
Attempt to gain unauthorized access to our systems, App source code, or other users' accounts.
Interfere with or disrupt the operation of the Site or App.
Resell Products purchased from the Site without our prior written authorization.

8. Disclaimers

THE SITE, APP, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TREDERA AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, APP, OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Tredera from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, App, or Products, or your violation of these Terms.

11. Third-Party Services

The Site is hosted on the Shopify platform, and orders may be processed using third-party payment and shipping providers. We are not responsible for the practices or performance of these third-party services, which are governed by their own terms and policies.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state in which Tredera is organized, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in that state, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
